Everybody knows the basic rule – a person must not kill another. When it comes to dealing with the estates of victims of an unlawful killing, that rule becomes – a person shall not kill and inherit.
It is a general rule that a person shall not obtain any benefit that flows from their unlawful killing of another.
This is according to the Law of Succession Act which states that : A person who while sane, murders another person shall not be entitled directly or indirectly to share in the estate of the murdered person.
The nation has experienced tussle-related assassinations over the years with an aim of receiving inheritance of an unspecified amount. There are plenty of cases in which business partners, friends, families and spouses kill each other over properties in cold blood.
The greed for money often makes it all messier and people are relentless in their quest of getting rich quick.
We take a look at this case where the 69-year-old tycoon Cohen and his Kenyan wife Sarah Wairimu were embroiled in a bitter divorce case which saw him file assault charges against her .A week later on on July 19, 2019, Tob Cohen was reported missing and due to the triangulation of a mobile phone that showed the location of a worker who had been fired from golf tycoon’s house days before the billionaire disappeared cracked open investigations that had almost gone cold lead to the arrest of his wife,Sarah Wairimu .
DCI allowed to hold her and detectives believed she had something to do with her disappearance.
Earlier today ,led by a team of detectives, DCI Kinoti discovered his decomposed body tied up in an underground storage which was empty and had been completely sealed with concrete & guised with bushy wood cutting in his Kitisuru residence.
Mr.Kinoti revealed that he was tortured before his murder .
“It is a gruesome murder, they took their time to kill innocent Cohen.He was bound; legs, hands and neck before he was murdered and then they hid him in an underground water tank. They took their time,” said the DCI .
Being the main suspect of the case, Sarah Wairimu is believed to have plotted the murder of her husband because she wanted his inheritance without the trouble of a divorce .

This was no random killing,it was a carefully executed plan designed to bring about the death of Mr Tob Cohen.
After discovery of the body , Former Gatundu North MP Patrick Muiruri disclosed how trouble rocked between the late Mr. Cohen’s Marriage.He reported of an incident where Sarah grabbed the mic from Mr.Cohen when he tried to greet the guests during their adopted daughters wedding .
“You do not own this home, you are not wanted here,” Muiruri quoted Sarah.
Muiruri added that the night he went missing,he talked to Cohen where he told him that his life was in danger and if he was to be found dead,then Sarah would be held responsible.
“He was very concerned about his life. He never hid the fact that if anything happens to him, if he is found dead anywhere, Sarah his wife would be responsible,” the former MP said .
Mr.Muiruri insists Sarah is behind Cohen murder and she will face the law .
“ If she murdered for property she will not get it. If it is for the business she ran with Cohen, which only meant to promote golf, the business is dead because no golfer will do business with Sarah,” he added.
Cohen’s wife Sarah Wairimu was arrested on August 28 and is currently being held at Lang’ata women’s prison and was on Thursday this week arraigned in court to face murder charges but did not take plea .
